On September 18-19, 2025, the Ninth National Congress of Civilians, the largest scientific event in the field of private law, was held in Sopot. This year's edition, under the theme "60 years of the Civil Code. Balance and Prospects for Change," brought together hundreds of legal researchers and practitioners to discuss the balance of past experience and prospects for change in the Civil Code.
The program included topics that are particularly important today: the limits of civil and insurance liability; contemporary problems of property law; contemporary problems of inheritance law; challenges of digitization and digitalization of civil law transactions; and challenges of Europeanization of civil law transactions.
In a panel devoted to contemporary problems of inheritance law, Julita Zawadzka, PhD, partner at KKG Legal, presented a paper entitled "Claim for the Return of the Sum of Money by which the Reserved amount was Reduced (Article 997¹ § 3 of the Civil Code). An Evaluation of the New Institution of Inheritance Law". Julita Zawadzka, PhD, discussed the legal nature of the claim under Article 997¹ § 3 of the Civil Code and the manner of its assertion, as well as the nature of the judgment rendered as a result of granting the demand for a reduction in the legitime share, and the impact of this judgment on the claim later asserted for payment of the amount by which the legitime share was reduced.
The paper was not only an excellent opportunity to analyze the new regulation, which, since its introduction into the Polish legal order, has sparked discussion of its practical meaning and the consequences for the protection of those entitled to a legitime share.
