The legal monograph “Notarial Actions. Uncommon Problems Arising in the Practice of a Notary” is now available for sale! The publication, published by C.H.Beck Publishing House, is one of the first comprehensive studies devoted to the challenges that notaries face on a daily basis. The authors - both theoreticians and practitioners of law - analyze non-obvious problems related to notarial acts, in the context of substantive and procedural law, taking into account both current problems and issues of a timeless nature.
The monograph was created as a result of the nationwide scientific conference “Uncommon Problems in a Notary Office” held last April at the Faculty of Law and Administration of the University of Gdańsk. The speakers included Julita Zawadzka, PhD, a partner at KKG Legal’s Real Estate, Investment, and Construction Law Practice, who presented the issue of reconciling the contents of the Land and Mortgage Register through a notarial deed.
She further developed this issue in a chapter published in the monograph, in which, among other things, she discusses in detail the principles governing the basis for entry in the land register, analyzes the possibility of using a settlement agreement as a basis for entry, and presents the prerequisites for its conclusion. The publication also addresses the admissibility of such agreements and the risks of undermining them, providing readers with a sound and practical analysis of the problem.
